  • help with extension

    hi , my mom has m visa for 5 yr, this is her second visit . she has been staying again for 6 months and and the end of this month she has to leave, but i want to apply for an extension. should i do it or it is too late? i am very concern that this possible extension can affect her m visa and next entering to this country. pls advise me wht to do

    I strongly suggest NOT to apply for an extension;

    She has already stayed 6 months on her 2nd visit and even if she gets an ext approval, such long stays are not advised as the officer will tend to assume
    an immigrant intent on future entry and may create problems for her.
    Remember , entry on a B1/B2 is entirely at the discretion of the entry officer even if the visa is valid.


    Anyway, It is kind of late. They take months to process the app and she likely won't get a response even when she is ready to leave after the extension. In case of a denial
    one must leave asap and when she enters next, she will have to satisfy queries from the officer, show the denial letter, evidence
    when she left , which could be hasslesome for her.

    Advice: Never schedule the departure for the last week of the 6 month stay.
    In case of an emergency (illness etc) , you won't have time to extend and
    she will end up overstaying and risking her visa.

      thank u so much for your advice. it helped me so much. if my mom stayed 2 times for 6 months each and she comes to the states after 6 months staying in her country will she have problems to enter to US third time?

        No, she should not have any problems with a 6 month interval . But she should shorten her stay on every visit from 6 to 5 months.
        A full 6 month stay on each visit MAY arouse suspicion of immigrant intent
        and she will have problems getting a 10 yr visa when this visa expires.
