  • Extension of Visitor Visa

    Hello!
    I had applied for extension of Visitor Visa for my parents on the 30th of July. They have a 1 year Multiple entry Visa and their original date of travel was Sept 3rd. Their Current I-94 expires on the 5th of Sept. I still have not received the receipt from USCIS and unfortunately I don't have the Delivery Notification tracker of my Application. What should I do? I had already booked a ticket for 22nd of November for them. Would sending a copy of money order along with copy of application help? And would keeping the Del Notification receipt of that letter help in proving that we had applied for extension? Please let me know asap. Or would going to Canada and coming back would give them a new I-94 as a last option? Please reply asap.
    Thanks

    What you should do is have them leave the US before Sept 5.

    The reason they have a 1 year multiple entry visa instead of a 10 year visa is because the VO wasn't convinced of their intention to return.

    With their 1 year visa, ideally they should have left the US within 3 months of their arrival.

    If they take an extension at this point it will be proof that the VO's suspicions were correct.

    So if they extend their stay this time then the next time they go to the consulate for another visa there is a very strong possibility that they will be asked tough questions and they might be rejected.

      smohanty is correct. one should never apply for an extension on a one year visa. and one should not stay full 6 months on a one year visa. this way
      the next application for a 10 year visa will be denied.

      the safest thing to do;
      if you wish that your parents should get another 10 year visa, for which the chances are reduced now, you should reschedule your parent to leave in a couple of days even if it costs you money with the airlines. forget about the extension. and forget about going to canada.
      they will not be allowed in from canada because it is the end of their stay and entry inspectors know why you are doing it.

      do not mention anything about extension to the visa officer the next time your parent applies for another visa.
      There is another complication that you must sort out; if they leave now they will not be depositing
      their I -94 at the airport because it is with the extension application. This way the system will not record their departure.
      they must send to CBP by mail, the evidence of their departure so it is recorded.
