  • urgent question on visitor visa extension and multiple entry

    Hi all,
we have A situation. Our parents came to the US 9 months ago with the visitor visa and got the stamp for 6 months and we applied for extension and it got denied recently and they have leave the country within 30 days. They have multiple entry visa which is still good till 2010. Is it considered as cancelled eventhough they are leaving the country within 30 days? Can they use the same multiple entry visa or do they have to re-apply for the visa.

Your reply is very much appreciated. Thanks in advance.

The section 222(G) and its interpretationg is very vague. It is in their best interest to leave before the 30 days expire, but it will be up to the officer at the POE to allow them to enter or cancel their visa next time they come to the US.

If they leave before the end of 30 days, their visa will be fine.
They just have to show the denial letter and the evidence of date of departure( boarding pass) on next entry.

USCIS says 30 days but I suggest they leave asap.

        Plan properly.

Please plan properly. Don't wait for exactly 30 day period. Plan to leave well in advance. That does not mean tomorrow, but definitely not on the 30th day. Do the math and use the most uncommon, common sense.

Make it easy for you and your family to visit in future.

        Good luck.
