  • Extension of Visitors visa for consecutive trips

    Situation :
My Parents have an 10 year visitor visa expiring in 2010. This is their 3'rd trip to the US. First was in 2001 for 4 months stay. Second was in 2004 for 6 months plus an extension of 3 months which was approved and they returned within extended time. They came back into US in 2007 after staying 2 years in India. They got a 6 month stamp this time, but the Officer just made a passing verbal comment "Do not extend ." However, he did not make any written remark or stamp on their passport about extension. We wish to apply for extension of their stay this time too for just another 2-3 months.

Question: Given their travel pattern (3 visits in 7+ years) and past stay history does anyone see any potential risks of denial of extension just because extension was applied for and taken on their last trip too?

Thanks in advance for answering my question.

The officer may not have written anything in their I-94. But, he probably did put something into the "system". In his computer he could have flagged them for no extension.

    You never know.

That's true. But assuming that he did not write anything into the system, is it still OK to apply for extensions on consecutive trips giving different reasons both times to extend?

If he did put something in the system, the extension WILL be denied. You parents visa may be cancelled under 222(g).

If he did not put anything in the system, but the extension is denied. You parents visa may be cancelled under 222(g).

Too much risk just for a few extra months. I would not do it. But you are welcome to try.

Different reasons (for the extension) have nothing to do with whether it is approved or not. It must be a "real" reason.
