I currently sponsored an individual for a student visa from Ecuador. The individual was in the United States with a tourists visa and then filled an extension. While the extension was being processed, she was preparing all her school documents and I was preparing my documents as a sponsor.
She currently returned to Ecuador and went to her interview for the student visa. While being interviewed, she was told that the extension process is the reason she is being denied the student visa. The agent claims that she was in the United States illegally and that the extension was not a valid reason for her extended stay. But after contacting many agencies here in the States I've been told by all that the agent is wrong. That the extension is valid and she was allowed to stay here in the states. Is there a regulation in the procedures handbook or any other form in writing that she can show the agent that the extension is a reason she could've stayed.
