  • Got I-94 extension after applicant left US

    My mom was here on B2 visitors visa, her I-94 was getting expired on Jan 16th. I applied for I-94 extension, but she had to leave US before her extension was approved because of health reasons. She left on feb 5th.

    Now the USCIS website case status says the extension is approved and notice sent. I am yet to get the approval notice

    My question is,

    1. Should I return back the extended I-94? If yes to where? Any procedure to be followed so that she doesn't end up in any problem if she has to return back to US.

    2. Any documents she needs to keep which will proove that she didn't stay for the period extended.

    3. What documents she need to bring when she is coming back to US (may be in Dec 2008), to convince immigration officer that she didn't stay too long?

      I called USCIS and explained them the situation. They directed me to CBP i.e Customs and Border Protection as they have got nothing to do with I-94 once approved.

      I called CBP to find out even they have got nothing to do with approved extended I-94, actually my Mom had handed over her expired I-94 to the official while exiting US. So returning this approved extended I-94 doesn't make any sense now.

      CBP asked my mom to hang on to the receipt of notice. i.e she would need to get the receipt and the approval notice when she is coming back to US, just to proove that she didn't overstay.

      Moral of the story, She should have shown the receipt Number of Application for extension while exiting.

      If you had a similar expereince and you resolved it in a different way, please let me know.

        Returning to US

        My mom had extended the B1/B2 visa to stay another 6 months in US (total staying 1 yr). After she went back to her country, how long she can come back again?

          She needs to stay at her home country MINIMUM 1 YEAR... I'd recommend two years.

            That has got nothing to do while exiting. While re-entering again, carrying that would help if the extension was approved.
