  • Visitor Visa Extension - e filed

Okay so I have e-filed I-539 for my mother and according to USCIS they have mailed the receipt too.

    1. Pending decision, how long can my mother stay legally in US? Can she stay even after her I-94 expires (approx 7 weeks from today)?

    2. I have not mailed any supporting document (copy of old I-94 etc.) to USCIS. I called USCIS and said that I dont need to send unless they ask for anything. Should I wait for RFE from USCIS or should I mail the documents listed in your website?

    Thanks!

1.- She can stay past her I-94 date until she gets a decision... but beware... if the decision is a denial, her visa may be cancelled due to 222(G). So, if she has not heard anything before the i-94 is about the expire... I would rather send her back home than risk the visa being cancelled.
