  • Visitor Visa Extension - Paperwork question

    Hi,

    My mother is here with us.She has 10 yrs multiple entry visa. I had sent my paperwork in 2004 for her visa. Her I-94 expires in Nov 08. My sister is going to have a baby during the same time. My mother wants to spend sometime with the new born (her grandchild) and hence we are planning to apply for her extension. (for 2-3months).
    My question is since I sponsered the paperwork when her Visa got approved in 2004, am I supposed to send all my papers this time for her Visa extension as well? Since she is going to spend time with my sister, should my sister send all the paperwork? OR should both of us send the papers? (employment letter, bank statement etc)

    Any experience sharing in this regard is appreciated.

    My personal advice is send your mom home right now and have her come in November for 2-3 months.

    Extensions are NOT easily granted and you would be putting her 10 year visa at risk.

        I have heard that the chances of my mother getting 2-3months stay granted if she returns back within such a short time span is slim.
        Pls share your thoughts.

          They will at least grant a stay for a few days. After all, it is just to see the grand kid. If the extension gets denied, then the visa is void and will result in more troubles for getting a visa for a future visit.

          Have her leave early than use the entire period from the current I-94 and return at a future date.

            Would it be safe to go back around Aug 20th and come back Oct 15th? Her I-94 expires Nov 11th.

              The sooner you send her home (July 20th). The better chances she has of getting back with a 6 month stamp on her passport.

                Hi,

                Just posting my experience...my brother left on April 28th and came back today July 8th. He was granted 6 months on his I-94.

                I guess it all depends on the officer at POE.

                  That is true. But an observant one in the future can notice this pattern and if s/he determines it is abuse, they can even refuse entry and put them in removal proceedings directly.

                  It is better that your brother not use the complete 6 months on such frequent visits even if the POE granted it.
