  • Extension of Visitor Visa for inlaws

    Hi all,

My inlaws aged 72 and 65 visited US in june and have I 94 till the end of december. Now, they would like to stay for another 3 months to be with us when we have our baby in February. This is their first time to US and they have 10 year multiple entry visa.

Does anyone have previous similar experiences. If so what reason was given to USCIS for extension of stay.

I would like them to stay without jeopardising their 10 year multiple entry visa as I have heard that they would be denied entry in their next visit at Port of entry.

    Please advise.

    Krishna

There is no guaranteed way to get an extension. Some people get it and some get denied. So, in short, there is a risk of the 10 year visa getting revoked due to overstay past the I-94 date if the extension gets denied.

Delivery is not valid reason for stay. They should have planned their visit better and it would be a non-issue.

They need to retun home and visit in a year.

June to September is 4 months... send them back RIGHT NOW... and have them come in February.
