    Hello all,

    I have applied an visa extention for my mom and her I-94 will expire on 01/10/10 and I have recieved the reciept from the USCIS service center.

    My question is , if we haven't recieved the approval or reject notification before 01/10/2009, Is she allowed to stay here till she recieves the letter..?
    Is there any problem if she stays even her original I-94 expires..?

    Appreciate your advice...

    basically yes, but if her application is denied, she has to leave the US within 30days and no new I-94 will be issued to her, but careful next time when she comes to US again she'll have a trouble of being questioned by the immigration officer. Better keep all the record/ correspondance between she & USCIS communication, and present to the officer at the airport next time when she enters US again. However, if her case is approved, she'll have a new I-94 with extension date.

    And i've a question as well, i've applied for the extension of stay on Oct and my visa stamp is gonna expired on Dec 11st. I've decided not to wait for the decision from USCIS as I dun wanna get into trouble when next time i enter US. So I'll leave on Dec 8th. But problem is, my original I-94 has sent together with the extension application, now I only have a copy of I-94. Is that okay to present the copy at airport for departure?? Anyone can help?

      If the extension gets approved, then there is no problem. But if the extension gets denied, she will be in trouble. You can check similar queries and details here - http://immihelp.com/forum/showthread.php?t=10871

        According to the thread and the replies my understanding is that,

        If we haven't recieved the approval/rejection letter , then she can legally stay in USA, till she recieves either of the letters.

        Please correct me .
