  • Applied for Visitor Visa extension

    Hi,

I have a visitor visa question as below.
Anyone please let me know if you can help on this.

My mother's I-94 was expiring on Dec 31st 2008 (she was completing 6 months of her stay and has multiple entry visa) and I had applied for the extension as early as Nov 2008.

In my application to the USICS, I had requested them to grant I-94 until March 31st 2009 even though she was eligible for another 6 months until June 2009.

I have received the Notice of action letter but still awaiting for the extended I-94 letter.

Now my question is can I postpone my mothers journey date from March 31st to say like May 15th, which will be still within 1 year limit for a visitor when I am awaiting for the I-94 extension?

    Will it be a problem?

    Please advise.

    Thanks,
    Nagaraj

No one is "eligible" for an extension. If the extension gets denied, her visa will be void. She should leave by the date as originally requested or be red flagged forever meaning difficulty in getting any more visas and at POE.
