  • Extension of Visitor Visa - question

    I have applied for an extension of visitor visa for my mom. It has been 2 weeks since I mailed the application and havent received a receipt number for the application. Can you please suggest how long does it typically take to receive just the receipt number so I can track the application and in case I dont receive it, what do I need to do?

    Did you write a check? If so, the back of the check will have the receipt number. Get it from your bank or look it up online.

    You should be getting the receipt anytime now.

      Thank you for the quick reply. I sent a money order and not a check which i guess will make it hard to track. My mother has till June 5th on the I-94 card, which is the reason i am worried that I havent received the receipt number yet (proof that we applied for extension, so she can stay beyond June 5th).

        Staying past June is risky anyway without knowing the decision of the extension as a denial will void the visa. You are not mitigating any risk by getting the receipt. As long as you have proof of delivery to USCIS, they would have got that and will send you a receipt.

          Oh. Is it not true that she will have 30 days to leave U.S after we receive the decision, if the application is denied?

            it IS true. But those 30 days are for her to leave before she is DEPORTED.

            If her I-94 expires, and later her extension is denied, she would be considered out of status from the day the i-94 expired. So her visa would be void.

              If she stays past the I-94 expiry while the application is pending, will it be difficult next time she tries to enter U.S?

                If she stays past the I-94, and the petition is denied (even if she left the USA before she got the results, but after the I-94 expired) then then visa is voided.

                So, yes, she would have problems to come back, she needs to apply for a new visa after overstaying her previous one... which Consular Officers do not like.
