  • Second request for extension of stay

    Hi,
My mom visited me first time on Jan 17, 2008. Her I-94 allowed her to stay 6 months. She asked for an extension which allowed her to stay in total of 11 months. She went back to Thailand on Dec 5, 2008. Then, she come back again last week, Aug 7, 2009. This time she had a very intensive interview, and got a stamp of 'Stay limited per SII NO EOS/COS' with a 1-month stay period.

She really wants to stay longer than that. She asked me to request for her extended stay again. Does she have any chance to get another extension again? Should I prepare more documents to support her extension request?

    Thanks,
    Cookkai

    No to both your questions.

The USCIS will reject the extension as soon as they see the I-94 annotation that states that your mother is not to extend her stay or change her status while she is in the US.

Have your mother to leave before the one month is up and tell her not to visit at least for the next two years.

Also tell your mother that her visa situation is precarious and that if she tries to challenge the system in this obvious way she may be sent back home from the airport the next time she comes in and even worse her visa may be revoked.
