  • Extenstion req for 3rd time

    Hello,

My Mother in law has 10 yrs multiple visa and she visited US in 2006, 2007 and now in 2009-2010. Both in 2006 & 2007 we got her visa extended for 3 months and did get approved.

This is her 3rd visit, she came to US in Oct 2009 and I am thinking again to extended her stay for 3 more months. I am just wondering if it's get denied? will it jeopardize her 10 year multiple visa?

    Please share your thoughts.

    Thanks,
    KK

    Extenstion req for 3rd time

    Hello Kumar,
My parents also have 10 years multiple entry. They visited me 3.5 years back and I didnt extend their visa at that time and they left US promptly before the I-94 expiration date.
They are here with me now and they have 2 months left in their I-94. I am trying to extend my parents visa for the first time. Could you send me the sample letters that you used to extend your mother-in-laws visa? Did she not have any problems when entering US during 2007 and 2009 especially when you got her visa extended for 3 months in 2006 and 2007?

Sorry I am no expert in these matters hence I am not in a position to help you. Please do share you experience with me.

    thanks
    Ram

      Extenstion req for 3rd time

She had a severe back pain and we could not take her around since being a winter. I have mentioned the same in the cover letter to USCIS. Also, we attached air ticket as a proof.

Hoping someone might have gone through 3 times extension without any issues -

      Thanks,
      KK

        Extenstion req for 3rd time

        Hi KK
Thanks for your reply. I have couple of questions
        - back pain + couldn't travel in winter were the only reasons you gave for both the times?
        - return ticket was attached to show the fact that your m-i-l will leave US before the I94 expired if the extension was denied? Did you mention this in your cover letter.

could you please be a little elaborate? If you don't mind could you attach the cover letter masking any information that you don't want to expose?

        thanks
        Ram

Regarding your case, jeopardizing 10 multiple entry is unlikely as long as your m-i-l leaves the US before the cut-off date in the denial letter. I read in this forum that it is not illegal to stay beyond the I-94 date as long as petition for extension is filed with USCIS and is pending. It is illegal to stay in US for even 1 day beyond the cut-off date in the denial letter. I am sure you know all this. You concern of whether you are pushing your chances to the limits by filing for an extension for the third consecutive time is valid and I hope someone who is more knowledgeable would help you with your questions.
