  • URGENT: Visitor visa extension rejected - need help/info on I-290B

    Hi,

I have applied visitor visa extension for my grandmother and today we received the deniel. It's written as below.

    -----
There is no appeal to this decision. However, pursuant to 8 CFR 103.5, a motion can be filled on Form I-290B such motion must be accompanioed by the proper fee and filed within 30 days of this notice.

    --------

Her i-94 is alreadt expired (On March 10th 2010). Can you please suggest what are the options we have. how to file I-290B, will there be any issues in filing this. Do i need an attorney to file this...can some one please suggest what need to be done here.

I have also seen that NWRI work sheet need to be filled, what need to be done here.

How many days she can stay afetr the deniel. Will she have any issues while travelling back?? can she come again to US with the same visa (as she stayed after her i-94 expire)??

    please share your experiences.

    Hello Vamshi,

My parents are also in a similar situation.. their i-94 was still Mar 9. I applied for extension by Feb 1st week. Today (April 24) I got the denial.

My letter also had the same details saying that a Motion that can be filed.
Did you find out anything about this?

I will be calling an attorney sometime this week.. I will let you know what he has to say..

If you hear something please reply to this thread or contact me at [email protected] and let meknow..

thank you and good luck.. hopefully, we will be able to file for the motion and get a favourable decision.

    thanks,

      HI,
I'm in a similar situation. My parents' visa expired January, we just got the denial on 4/29. I've asked numerous people online on what the success rate is filing a I290B and how do we fill out properly to persuade the court, but do not have any answers.. What did you do? Please reply at [email protected]

If anyone knows anything about cases like this where I thought I submitted enough evidence to confirm that the stay is temporary, but INS did not believe it is, then please suggest something as time is running out for me too.
      Thank you.
