Extension for parents B-2 Visa: Mother didn't get I-94 but father did

  • Extension for parents B-2 Visa: Mother didn't get I-94 but father did

    Hi All,
    I have filed an extension for my parents B2 Visa. I have got extension approval but only got I-94 for father and did not find I-94 for mother. I did attach Supplement-I with my mother's details.

    I just happen to look at my application, I-539. I found that I checked the following:
    Members of my family are filing this application with me.
    The total number of people (including me) in the application is: 1


    Is it customary that I only receive I-94 for the principal applicant (in my case) and don't have to worry about?

    If not, please share your thoughts. Do I need to file seperate application for my mother at this point?

    Each person gets a separate I-94.

    If you put total number of persons in the application as 1, it looks like your mother's extension was not processed.

          Sri,

          Can you please let me know how long was the processing time for the B2 extension for your parents? Which service center was it and did you e-file? I hope your mom gets her I-94 soon.

            Extension for parents

            Hi,

            My parents stay in USA is till May 18th 2010 and i already applied for there extension which reached the office on April 8th. My question is should they wait to receive there extension and if they wait for the extension and it doesn't get approved will they still be legal? I heard there's a risk of terminating the Multiple entry visit visa if they stay after there last date before getting the approval. Should they leave on the date? Is there any chance of denial?

            Any suggestions will be helpful.

              The whole process took around < 45 days. We paper filed to VSC. I hope this helps. Thank you for the well wishes.

                All your fear is unfounded. As long as the application is filed before the expiration you are covered. You would be legal until they make the decision. If by chance they deny the extension they will give you around 10 to 14 days to leave the country. Cancelling VISA might not happen if they leave within the above grace period. So don't worry.

                    Thanks QuickGreenCard. When you requested the extension, did your parents sign the letter listing the reasons for the extension or was it signed by you?

                    On the Q raised by UNikhath, I believe if one's parents overstay and the extension is subsequently denied, the visa becomes void and need a new visa for re-entry.

                      UNikhath,

                      My understanding is that if your parents stay beyond May 18th and the extension is later denied, their visa becomes void. Grant of the extension depends on whether the reasons you gave are convincing to the visa officer.
