My Mom's I-94 expires on Sep 4th, 2010 but her return ticket is for Sep 5th. Will it be a problem if she travels on Sep 5th?
If yes, then we are planning to file for an extension and travel during end of Sept. Because we are filing at Vermont center, the processing time for I-539 is 3 months. We are not planning to wait for the decision. Is this OK?
If her request for extension gets approved, then all I have to do is to send her the new I-94. Is this correct?
But if her request gets denied after she leaves the country, will this be a problem when she comes back to US next year?
