  • Visitor Visa Extension

    We would like to extend the visa by about 2 months for my in-laws (I-94 expires in mid September). I am changing job and moving to a new city; so, we are thinking my wife would apply as she would move only after 2-3 months. However, she is on maternity leave now; so she will not have her recent paystubs.
    - Will not having her paystubs create an issue? (she will still have her employment letter, bank stmts,)
    - I see paper filing (at CA service center) takes 2.5 months but other service centers takes more time. Is this true? Is e-filing better?
    - Also, we are planning to have the return ticket originating from the new city where I would be working. We are thinking of giving a reason to see a tourist spot nearby and then flying out from there. Will this be a problem?

    Your parents in-law can apply for extension of status and you or your wife can show funds for their extended period of stay. They must apply to appropriate service center as per I-539 instructions. efiling is neither slower nor faster but the system automatically generates the correct address to send supporting documents.

      By the way, in case the petition is denied, is there a number of days within which they should return back? Also, in this case, would the number of days they overstayed be construed as illegal even though they were waiting for their decision?

        If application is denied before their I-94 expires, they must return before the I-94 date.

        If applications is denied after I-94 expires, they must depart immediately. Even then their illegal stay is counted from I-94 date and their visas are void. Denial notice will give a 30 day window, but that is not considered legal stay, it is only a period during which DHS does not start removal proceedings.

            we are planning to send I-34 for extension for my in-laws but have only one original of employment and bank letter. are zerox copies acceptable? i-134 requires evidence in duplicate.

              FYI-Applied for extension last month and got it approved this week. I was surprised at the early response since WAC takes about 2.5 months. Thanks for all your help.

                Do not be suprised. When you apply for extn during July to Oct, the WAC responds faster and mostly those applied gets extn. I applied on 30th Oct for an extn and got approval on 17th Nov.
                Not only happened to me but some of my friends also.
