  • Visitor Visa Extension and Revisting

    Hello,

This information will really help me, please reply as early as you possibly can.

    Background
I live in Chicago and my Parents visited me back in 2008 for 6 months. I however applied for their extension beyond the 6 month time, and we got the approval from USCIS on the same. But my parents only stayed in Chicago 15 days more than the original 6 months of I-94, ofcourse after we received the approval on the extension (which makes it perfectly legal).

Here is the issue (not sure if it is though) - My parents left Chicago to India before they received the extension approval and the new I-94. Now the new I-94 forms are with me.

    Question

    1. Can my parents just use a photocopy of the extention approval I-94 - both at the Airport in India and in the Port of Entry in Chicago?
    2. Would the Immigration folks in Chicago ask for the Original extension approvals?
    3. Is there any other documents they would need from me, that can help them have a smooth immigration?

Would really really appreciate your help.

    Thanks
    Srini

You should send back the I-94 immediately https://www.immihelp.com/returning-u...4-form-to-cbp/

And send the original extension notice to your parents.

      Thanks for a quick reply.

I will send the original approval letters I have for my mom and dad.

Do I only send the Approval letter, or do I also include the Receipt notice we got from USCIS (when we applied for extension)?

Also, Giving this original at the port of entry in Chicago (as my parents want to be here this week or next week) - would that clear them to enter in to US?. Or would there be any objections from the immigration officials?

Thanks much in advance for your response

Tear off the I-94 from bottom of the approval notice and send it to Kentucky address from the above link along with a cover letter and proof of having left the US.
Send the remaining approval notice to your parents. They will need to produce it only if they are asked about it. Make sure they understand the matter completely so that they can answer any questions clearly.
This is my opinion and not legal advice.
