    Hi:

    I have a different situation , my parents visited USA for the 3rd time. Its almost a year from their last visit to the current visit. This time they got only 3 months in their I 94, i was bit surprised, I thought by default they give 6 months in I -94.

    My question is Do I have a clean case to apply for the extension, I am planning to extend them for another 2 months.

    I have another 38 days left in their I-94, planning to efile today. Let me know if you have any advise regarding applying extension for my parents

    First of all you don't apply for any extension, your parents apply for their own extension. They need to have a genuine reason and documents supporting it.
    It can take 2-3 months for USCIS to process the application. If extension is denied after their I-94 dates are past, their Visas are automatically void and illegal stay is counted from I-94 date.

    In general, at POE visitors have to tell the officer how long they wish to stay and they may be asked to provide travel plan and itinerary to support it. It is still at the officer's discretion as to how much of a duration is permitted. 6 months is only a maximum.

      Thanks for the reply.

      I am afraid they don't have the 45 days of lead time that we need to follow to apply for the extension, they have around 38 days is that ok?

      Is e-file better as it give you atleast a submission proof right away instead waiting for a submission proof in the mail?

        Yes, it is better in that way. No different in terms of processing time.
