  • Apply for visa extension application again ??

    Dear All,

    My mom has 5 years multiple B2 visa for the USA and she got 6 months visa at the port of entry. I have already filed for the extension of her stay until the end of October (Her visa is going to be expired in September). However, for some reasons, we have to change her return date to the second week of November. What should we do in this case ? Can we just call USCIS and ask them to change the date ? or Do we need to file for her visa- extension again (can we even do that ?) ? Or, she can just over-stay for 10 days ( provided that the application of extension approves) and return back home on November ?

    I am desperately looking forward for some good answers.

    First of all remember the fact that Visitors are only allowed to stay in the US as per their I-94 date.
    Filing one extension application itself is an action out of ordinary from immigration point of view. If your mother attached cover letters and travel tickets showing Oct dates in her application, it is better that she stick to those dates. She can try and write a letter requesting additional period on the same application, but it is not recommended to file another application.
    If application is denied, her illegal stay is counted from I-94 date and Visa is void.

    Visa (in passport) and I-94 departure record received at POE are not the same thing. Don't use the word Visa for everything.
