  • Approval Notice arrived after my mother left to india

    Hi,
My mother has 10 year multiple entry visitor visa .
Last year when she was here due to an unfortunate accident for my wife,
I applied for a last minute extension of my mother's visa just few days before her
    original I-94 expiration date.
I applied for an extension for 24 days than the original expiration date Nov-2nd.
    From Nov-3 to Nov-27.
My mother left to india on Nov-27 as planned but I did not get the approval notice by then.
I received the approval notice after few months for the extension from Nov-3 till Nov-27.

She is returning to US this month and I posted the visa extension papers couple of weeks back. But the documents were not yet reached to her.

As time is running out, I'm not sure if I can still plan her to come here with out the original
    visa extension document (approval notice)?
I have the photocopy of the original documents. Would that be sufficient for her to show the photocopy? Would the immigration authorities have her record and let her re-enter without
any issues? Or should I wait till the document reaches her?
Ticket extension is very difficult at this stage.

If she try to come to US with out the approval notice would there be a chance that she will be
    deported?

We have only few days to decide. I really appreciate community help and suggestions on my
    condition.

    Thanks in advance,
    Krishna

Yes, it is very important that she carry the original extension approval notice with her.
Yes, they can cancel her visa and she can be asked to go back.
Because in their system , an overstay has been recorded.

I suggest you reschedule or cancel the current trip till she gets the notice.

*Should never apply for an extension so close the expiry of the stay unless really emergent. Response takes months to come.
*SHould have mailed her the papers much earlier . ( I hope you sent them by registered mail. Can't you track them?)

      Spoke with an immigration officer

      I appreciate your quick response.

Yesterday I went to airport and spoke with an immigration officer showing and explaining
      the situation.
He said USCIS will have the approval notice in their system and my mother should not have
any trouble re-entering. (Also I believe this because they gave the extension exactly on the day she left Nov-27 instead of till Dec-5 we requested)

But certainly it depends on the immigration officer dealing with my mother.

I also have a US notarized copy of this document(approval notice) which I'm planning to send it through one of
my friends parents so that she have the notarized version and I'm also sending the USPS
receipts etc., with a request letter from me clearly explaining the administrative delay due
      to USPS.

      Would that help?
Also I see status update on the post I sent that May-7th morning it cleared customes. My mother
stays in hyderabad. And we have 4 more days to wait for this letter. I'm hoping she would get
      the original before friday May-11.

Please give your thoughts & inputs.

      Thanks,
      Krishna

Thanks for support. Finally my mom received the original document.

I would like to thank peace999 for quick response to my question.
To our relief the original approval notice document I sent to my mother
reached her in time for her travel.
        We are so much relieved.

        Thanks again.

        Krishna
