  • b2 visa to expire

    hi,

Just need your advice. I am currently on b2 visa however i have already filed for an extension and they have approved it. I plan to file an second extension again because I need to take the exams and my visa is about to expire. Is it safe to file again? what are my chances of being approve the second time?

By Visa do you mean I-94?
Chances of second extension of status (I-94) are very low.
This is my opinion and not legal advice.

Chances are very low, B2 visa is for the purpose of visiting only, and looks like you have already overstayed the initial purpose which you told the VO while getting the visa initially. Though you are legally staying, it can certainly become an issue later on. By filing multiple extensions you are doing more harm to yourself and creating difficult situation for future visa stampings. Your extension may get denied and the next time you try to visit US they might give you only a month of legal stay or even deport you back to your country because of your overstay currently. This is my opinion not legal advice.

thanks all for your reply. I really appreciate it. my employer also filed for h1 b while i am on b2 however it was denied. so if i request for another visa ext i-94, how will it affect my future coming back to the US? do you think I will have difficulty applying visa and re entering US?

In spirit, you havent done true justice to the B2 Visa so you are likely to be questioned about what you were doing for so long in US on a B2 so be prepared to answer that. As for future entry to US you may be questioned at POE or denied entry all together so be prepared for this too. Consider yourself lucky if you are not. This is my opinion not legal advice.
