It wasn’t a surprise, as many of us were expecting retrogression to happen with the 2023 fiscal year report, especially for EB-2. The current October 2022 report has confirmed that the new EB-2 Final Action cutoff Date is 1st of April 2012, which is exactly -2 Years and 8 Months, and Filling Date is 1st of May 2012; i.e. -2 Years and 8 Months. The cutoff dates for EB-2 now look similar to EB-3.
This time EB-1 has consumed a fair share. With this rate there won’t be spillovers instead carryovers, which would atleast take up to 10 years to complete the pending applications from the 2022 fiscal year.
This is a huge set back for EB-2 applicants and this sends them back to 2021 December. However, based on September 2022 Visa Bulletin, USCIS might still receive the applications but cannot approve until the numbers become available. For now, this might stop applicants from transferring between EB-2 and EB-3.
