Subject: Adjustment of Status (I-485) application under AC-21 rule
Dear Sir/Madam,
My application to adjust status to a permanent resident (I-485) was filed on August 7, 2003. It was done so based on an approved I-140 (Petition for an Immigrant Worker) by my former employer, XYZ, Inc.
My details:
Name: Rahul Gupta
Receipt Number: EAC-123-43345343
A#: A43523424
Pursuant to the Employment Authorization Document (EAD) issued based on my I-485 application, I began lawful employment with ABC, Inc., on May 12, 2004. I am currently employed with ABC, Inc., as a senior software engineer, and the employment is in the same field and in the same position as my previous employer, XYZ, Inc.
The American Competitiveness in the Twenty-First Century Act of 2000 (AC-21) allows for a change of employer on a pending I-485 (Application to Adjust Status to Permanent Resident) that has been pending for 180 days or more. The AC-21 rule allows me to do so by filing a new I-140 petition.
As I joined my new employer, XYZ, Inc., after my I-485 application had been pending for over 180 days, I respectfully request you to adjudicate my I-485 application.
Sincerely,
Rahul Gupta
