My Immigration journey it took me five years plus. Receive Four different work authorization. thank the Lord the journey is over I can tell anyone to be patient and once you’re in a legitimate and genuine Marriage, you don’t need to worry. Do your necessary researche before you start your Immigration journey if you don’t it can take you a very long time and it can be really stressful as that is my advice to you. I want to say thanks to this platform it gave me so much strength when I was down I couldn’t wait for my time to come when I could write my experience but today I can thank the Lord, I might not come here much anymore, but any one who need help you can always reach out to me. Who qualifies for i601 alien smuggling waiver?
I've been getting mixed information from different attorneys and I just don't know who to believe and trust anymore. Seems like everyone has their own opinion. Here's the scenario - I am a naturalized US citizen. My dad is going through AOS and his interview is coming up. He entered the US without inspection but qualifies for AOS based on i245. He doesn't have parents or spouse with legal status. The only one with legal status is me- his daughter. Would he qualify for waiver for helping bring me to the US illegally as a child ? He didn't 'smuggle' anyone other than immediate family being his child.

Our attorney mentioned possibly needing to file a waiver if this is brought up during interview and we assumed he COULD apply for it if needed. But some attorneys are saying he does NOT qualify for waiver through a us citizen child because such waiver doesn't exist anymore.

Please someone help me and advise if he qualifies or not. If for some reason he doesn't qualify, then what happens? Would he go into removal proceedings? (No criminal convictions at all)

Just trying to get some feedback so I can know what to expect because I'm stressing for my dad!!

I601 Alien smuggling waiver for AOS (i245 with family based AOS parent of us citizen)
My parents have been residing in the US without status and are currently in the process of AOS. They have a i245 that allows them to adjust their status in the US. I am their naturalized US citizen child and I petitioned for them. My dad received his EAD in July and AP was denied because he did not enter with inspection. He just got notice for his interview and the attorney said theres a 'chance' the officer might require them to file for a waiver because they brought us (myself and siblings) to the US illegally as children. I'm trying to understand the likelihood of this being the case. I'm assuming they check status for all the children listed in the application and theyll see we're all on DACA and I'm naturalized meaning I wasn't born here which might be how they find this out. Of course we're hoping and praying this isn't the case because my parents have been waiting for this moment for over 30 yrs.

I'm hoping since they already scheduled interview that they won't ask for a waiver ? Or is it normal for them to make you go to interviews just to deny you and say you're inadmissable and need a waiver ?

Im also hearing that this waiver isn't even an option even if you smuggled your immediate family such as children.

Anyone has experience with this at all ? Thanks in advance!

I filed for a concurrent application with I-130, I-485 & I-131 in Nov 2022 and I currently hold a H-1B visa valid until October 2024

Can I travel to India and reenter USA with my H-1B visa? When I have a pending I-485 application with the USCIS.

Has anyone travelled outside United States with a pending I-485 application?

July 2 Online status changed to "Ready to schedule interview"
July 7 Received Cancellation notice for the interview that I already attended. Feb 15 2022
July 21 Received interview scheduled notice for September 26
According to attorney it could be an error. USCIS might wanted to cancel current interview but instead cancelled last one. But need to attend unless receive official cancellation notice.

Hi guys, we received RFE for both I-130 and I-485. The update for I-485 says we received your response for RFE, but the update for I-130 says case being actively reviewed. Has anyone had this happen before.
